CartStrings is a Klaviyo email marketing agency specializing in email strategy, campaign management, automated flows, deliverability optimization, popup and email capture strategy, and Klaviyo account audits for Shopify e-commerce brands. The specific scope of services will be defined in a separate service agreement or statement of work between CartStrings and the client.

2. Eligibility

By using this Site, you represent that you are at least 18 years of age and have the legal capacity to enter into binding agreements. If you are using the Site on behalf of a business, you represent that you have authority to bind that entity to these Terms.

3. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that violates applicable laws or regulations, attempt to interfere with the proper functioning of the Site, use automated systems to access the Site without our written permission, or impersonate any person or entity or misrepresent your affiliation.

5. Client Responsibilities

If you engage CartStrings for services, you agree to provide timely access to your Klaviyo account, Shopify store, and any other platforms required to perform the services. You are responsible for the accuracy of information you provide and for maintaining the security of your account credentials. You agree to review and approve deliverables in a timely manner as outlined in your service agreement.

6. Payment Terms

Payment terms, fees, and billing schedules are defined in your individual service agreement with CartStrings. All fees are non-refundable unless otherwise specified in writing. Late payments may result in suspension of services.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information exchanged during the course of the engagement. This includes business strategies, customer data, login credentials, revenue figures, and any other information not publicly available. This obligation survives termination of the relationship.

8. Limitation of Liability

To the fullest extent permitted by law, CartStrings shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services. Our total liability for any claim shall not exceed the amount paid by you to CartStrings in the twelve (12) months preceding the claim. Email marketing results depend on many factors beyond our control, and we do not guarantee specific revenue outcomes, open rates, or conversion metrics.

9. Disclaimer of Warranties

The Site and services are provided on an "as is" and "as available" basis. CartStrings makes no warranties, express or implied, regarding the Site's operation, accuracy, or reliability. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify and hold harmless CartStrings, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.
